Ibn Ezra on Exodus 20:13/אבן עזרא על שמות כ׳:י״ג

אלא תרצח. בידך או בלשונך, להעיד עליו שקר להמיתו, או להיותך רכיל או לתת עצה רעה בזדון שתדע שיהרג, או שנגלה לך סוד שתוכל להצילו מן המות אם תגלהו לו, ואם לא גלית אתה כמו רוצח:
1THOU SHALT NOT MURDER. With your hand or your tongue, that is, by giving false testimony which results in having someone executed, or by tale bearing,256 or by wickedly giving someone counsel which you know will result in his death, or by not revealing a secret which you are aware of, to someone who would be saved if he knew what you know. If you do not reveal the secret you are a murderer.
2THOU SHALT NOT COMMIT ADULTERY. Many think that the term ni’uf (adultery) only applies to adultery257 because they found Scripture stating, asher yinaf et eshet re’ehu (even he that committeth adultery with his neighbor’s wife) (Lev. 20:10). What reason is there to state this, having just said, asher yinaf eshet ish (that committeth adultery with another man’s wife)?258 spoken of in the first part of the verse can only be committed with a married woman. In other words, asher yinaf et eshet re’ehu (even he that committeth adultery with his neighbor’s wife) explains the term yinaf in asher yinaf eshet ish (that committeth adultery with another man’s wife). However, its meaning is not as they think.259 applies to all prohibited sexual acts. Now the previous verse reads, For whatsoever man there be that curseth his father or his mother shall surely be put to death; he hath cursed his father or his mother; his blood shall be upon him (Lev. 20:9). Its meaning is,260 he committed a great sin in cursing his parents who bore him. The same is true even of he that committeth adultery with his neighbor’s wife, whom261 he is obligated to love as himself. The word ni’uf refers to an illicit sexual act. Behold, we find that Scripture states, va-tinaf et ha-even ve-et ha-etz (and she committed adultery with stones and with stocks) (Jer. 3:9).262 (and she committed adultery) must be rendered: and she committed illicit sexual acts. For other interpretations see Weiser and Krinsky. However, it is unfit to discuss this abomination publicly.263 Saadiah Gaon says that there are many levels of illicit sexual acts. The least illicit level is sleeping with a virgin or widow.264 Next comes sleeping with one’s wife during her menstrual cycle, for she will be permitted to him in a few days. Then comes sleeping with someone else’s wife, for it is possible that her husband will die and she will be permitted to him. Next comes sleeping with a Canaanite woman,265 who does not follow Israelite law, without giving her seed, for it is possible that she will convert and he can then marry her. However, if he gives her seed then it is as if he himself is worshipping idols. Next comes sleeping with a male, which can never be permitted. Next comes bestiality, that is, intercourse with a nonhuman. The Gaon knew how to classify the various types of illicit intercourse,266 for Scripture decrees the penalty of karet267 for all of the illicit sexual acts listed in the Torah portion Achare Mot.268 Saadiah omitted intercourse with one’s mother, sister, and daughter from his list of different levels of illicit sexual acts.269
גלא תגנוב. משמע גנבה קחת ממון בסתר, ויש גנב שהוא בן מות כמו גונב נפש מישראל בין שהוא נער קטן או נלעג לשון והגנבה בממון בין בפניו בין שלא בפניו, או שרמהו בחשבון, או במדה, או במשקל, וזאת המלה גם היא כוללת מי שיגנוב לב אחר כאשר עשה אבשלום:
3THOU SHALT NOT STEAL. Stealing implies taking money secretly. There are thieves who incur the death penalty, namely, those who kidnap an Israelite, be he a child or one who cannot speak clearly.270 The prohibition to steal money applies both to when the owner is present and to when he is not present. It also applies to cheating in number, measure, and weight. The term stealing also applies to what Absalom did,271 that is, it prohibits deceiving another person.
4THOU SHALT NOT BEAR FALSE WITNESS. For many years I asked myself why Scripture employs the phrase ed sheker (false witness) and not edut sheker (false testimony). I now believe that Scripture is addressing the false witness, and our verse is to be interpreted as if it read, “Thou shalt not give testimony if thou art a false witness.” The implication of this clause is the same as that of neither shall ye deal falsely, nor lie one to another (Lev. 19:11). We find that a bet follows the word for testimony in and hath testified (anah) falsely against his brother (be-achiv) (Deut. 19:18). We also find this verb employed without a bet following it in yishma El ve-ya’anem (God shall hear, and testify against them) (Ps. 55:20).272 Now ve-ya’anem is a compound of ve-ya’aneh (and shall testify) and bam (against them).273 follows “to testify,” for the mem suffix stands for the word bam. The phrase lo nega’anukha (not touched thee) in as we have not touched thee (Gen. 26:29) is similar, as the meaning of lo nega’anukha is lo naganu bakh (we have not touched thee).274 suffix stands for the word bakh. Thus in both cases the suffix stands for a bet. There is a type of false witness who incurs the death penalty, namely, the one concerning whom it is written, then shall ye do unto him, as he had purposed to do unto his brother (Deut. 19:19).275
